TRANSPARENCY PROGRAM

Transparency Program for the Commissioner for the Right to Information and Protection of Personal Data

I. INTRODUCTION

In accordance with Article 7 of the Law No.119 / 2014 “On the Right to Information”, the Transparency Program for the Commissioner for the Right to Information and Protection of Personal Data
This program sets out the legal framework for the activity of authority within the law no.119 / 2014 “On the Right to Information” (LDI).
This program is evaluated as a concrete way through which the Public Authority (hereafter Albanian Post Sh.a.) builds and enhances transparency in its institutional work, under the guarantee of the LDI. Albanian Post sh.a. will update the Transparency Program from time to time, in accordance with item 2 of Article 5 of the LDI.
The information made public in this program aims to make the transparency of the work of Albanian Post sh.a. through its detailed coverage on the official web site www.postashqiptare.al as well as on the public reception venues. The transparency program is reflected in the sections, texts / content, time limits for making it public, the manner of making it public and the structure that produces or manages the document.
The transparency program contains a publication scheme, which reflects the menus where the document is addressed on the official website. In addition, each document is also accessible in the scheme.
The documentation made public will be updated in form and content. The official site of the Albanian Post sh.a is built in a form that provides information to the public without a request in easily understandable forms. In the columns of the official site are also reflected information that is characterized by personal identification data limitations due to the privacy of individuals / subjects of data etc.
The publication scheme is presented through the summary table highlighted in this program.

II. GENERAL PRINCIPLES

The main principles in which the Transparency Program of the Albanian Post of Sh.a. is based on are:
1. “Right to information” is a constitutional right provided for in its Article 23, accessible to all without exception.
2. Presumption of maximum publication of the data: Albanian Post sh.a exerts public functions, consequently the information derived from its activity is published in accordance with the legislation in force.
3. Correct implementation of the law and legal provisions that regulate in particular the activity of the Albanian Post of Sh.a and respectively: Law no. 9887, dated. 10.03.2008 “On Personal Data Protection” as amended, Law No.119 / 2014 “On the Right to Information”.
4. Information fits in a clear and understandable language.
5. The oversight body of public information procedures is the Commissioner for the Right to Information and Protection of Personal Data.
6. The revision of the transparency program shall be carried out under the same procedure through which its adoption has been made.
7. Public information without request should be:
• Complete
• Accurate;
• Updated;
• Simple in consultation;
• Understandable;
• Easily accessible;
• Compliant with original documents in possession of public authority.

III. INFORMATION PUBLISHING WITHOUT REQUEST
The information allowed for publication is explicitly provided in Article 7 of Law No.119 / 2014 “On the Right to Information”.
In accordance with this approved transparency program, Albanian Post sh.a puts the disposal to the public on its website www.postashqiptare.al and in the public reception venues the following categories of information:
§ Organizational structure of public authority;

§ Full texts of conventions that have been ratified, laws, sub-legal acts, codes of conduct, policy documents, manuals or any other documents related to the exercise of its functions affecting the general public;
§ Information on the procedures to be followed to make a request for information, postal and electronic address for filing requests for information, as well as the appeal procedures for the respective decision;
§ Data on the location of public authority offices, working hours, name and contact information of the coordinator for the right of information;
§ Data on education, qualifications and salaries of functionaries who have the obligation to declare the property according to law, salaries structures for other employees, and a description of the selection procedures, competencies and duties of senior officials of authority public and the procedure they pursue to make decisions;
§ Monitoring and control mechanisms operating on public authority, including strategic work plans, audit reports from the Supreme State Audit or other entities, and documents containing performance indicators of the authority;
§ Data on the budget and expenditure plan for the following financial year and past years, as well as any annual report on budget implementation. In those cases where the public authority is self-financed by license fees or any other form of direct financing from the entities regulated by it, the documents showing the state of settlement of the obligations by the licensed subjects are made public;
§ Information on procurement procedures or competitive concession / public private partnership procedures, respectively, according to the provisions of law no. 9643, dated 20.12.2006, “On Public Procurement”, and Law no. 125/2013, “On concessions and public private partnership”, performed on behalf of the public authority, including: list of related contracts, contracted amount, contracting parties and description of contracted services or goods, information on implementation and monitoring contracts, as well as different policies and guidelines;
§ Information on the services that the public authority gives to the public, including service quality standards, a description of categories and forms of social assistance, subsidies given by the public authority and procedures for obtaining them, information and documents required frequently, any other information deemed useful by the public authority;
§ Any mechanism and procedure for making requests and complaints regarding the actions or omissions of public authority, a procedure through which interested persons may present their opinions or influence in any other way in drafting laws, policies public or exercising the functions of the Albanian Post of Sh.a. a simple description of the system used by the public authority to maintain documentation, types, forms of documents, and categories of information that is made public without a requirement;
• § The Albanian Post sh.a also creates and archives a digital copy of its official web site, supplemented with the information required in the approved transparency program, as well as on the methods, mechanisms and periodicity of the publication of public information, which made available to the public without a requirement;
• § Acts containing rules, norms or limitations of the individual’s fundamental rights and freedoms and with direct effect to them are made public by publishing or posting on the official website within 48 hours from adoption of the act by the Albanian Post sh.a.

V. PUBLICATION
In accordance with this approved transparency program, Albanian Post sh.a. makes available to the public on its website www.postashqiptare.al and in the public reception areas, the above categories, in a special menu entitled “Transparency Program”.

VI. MONITORING
The Commissioner for the Right to Information and Protection of Personal Data monitors the implementation of the law on the right to information, promoting the principle of transparency in the work of public authorities, in particular by sensitizing and informing on issues of the right to information.
The Commissioner makes recommendations to public authorities regarding the conception and implementation of institutional transparency programs.

Law no. 46/2015 “On Postal Services in the Republic of Albania”

This law lays down the rules for the delivery and provision of postal services and universal postal service, as well as the conditions for access to the postal network in the Republic of Albania. It also specifies the institutions responsible for regulating the postal service, as well as the rights and obligations of postal service providers and users in the Republic of Albania.

This law regulates the status of a trader, the founding and administration of companies, the rights and obligations of founders, partners and shareholders, the reorganization and liquidation of companies. Business companies are corporations, limited partnerships, limited liability companies and joint stock companies.

Law no. 9918, dated 19.05.2008 “On Electronic Communications in the Republic of Albania”, as amended;

This law, inter alia, aims at establishing the Electronic and Postal Communications Authority (AKEP) as a regulatory body in the field of electronic communications and postal service, which oversees the regulatory framework set out in this law by the law on postal service. and development policies set by the Council of Ministers.

Decision of the Council of Ministers no. 1039, dated 16.12.2015 “On the Establishment of Procedures for the Issuance, Production, Use and Trading of the Albanian Postage Stamp”.

This decision sets forth the rules for the issuance, production, use, thematic and marketing of the Albanian postage stamp by the Albanian Post Company, in accordance with the international rules of the Universal Postal Union (UPU).

Decision of the Council of Ministers no.241, dated 31.03.2011 “On the performance by the“ Albanian Post ”sh.a. of the Postal, Financial and other Services, which are in accordance with the activity of this post, for the Governing Institutions Central and Local Government, Other Public Institutions and State-owned Business Associations ”, amended by Council of Ministers Decision no. 81, dated 28.01.2015.

This law stipulates that:

The Prime Minister’s Office, Ministries, Public Sector Institutions, whose activity relies on public property, state, local government institutions, and state-owned commercial companies, both on their own behalf and in the service of citizens and vice versa, to carry through “Albanian Post” sh.a, the following services: a) postal services; b) financial services, which do not contradict current legislation; c) Services, which are in accordance with the activity of “Albanian Post” sh.a., which are charged with the decision of the Council of Ministers or the minister that covers the activity of postal services.

The aforementioned institutions (with the exception of state-owned commercial companies after being removed by DCM No. 81, dated 28.01.2015) for other services, which are in accordance with the activity of “Albanian Post” sh.a., as a first provider,  should address this post. If these services are not provided by Albanian Post sh.a, then they may be provided to other operators.

For the services provided, according to this decision, “Albanian Post” sh.a. will apply market value oriented tariffs.
